Usage and Availability
The tenant has the opportunity to use the available Wi-Fi access free of charge during their stay in the holiday accommodation. This is a service provided by the landlord and can be revoked at any time. The landlord reserves the right to restrict the operation of the Wi-Fi at any time, in whole, in part, or temporarily. Access to certain websites or services via the Wi-Fi may also be blocked by the landlord at any time. This includes, for example, violent, pornographic, or paid sites. The landlord also does not guarantee the availability or reliability of the internet access.
Access
You have access to the Wi-Fi via a QR code located on a sticker on a table in your accommodation. By scanning the QR code, you will receive the access credentials, which are intended solely for your personal use. These must not be shared with third parties under any circumstances. Therefore, you agree to keep the access credentials confidential at all times. Additionally, the landlord reserves the right to change the password for internet access at any time. Overall, access to the Wi-Fi is permitted only for the rental period from [start date] to [end date].
Liability
The tenant assumes full responsibility for the use of the Wi-Fi and any risks that may arise from it. The internet access provided by the landlord does not include a firewall or antivirus protection. The provided Wi-Fi connection is only equipped with WPA2 encryption, which protects data traffic from unauthorized access by third parties. Additional protective measures are not the responsibility of the landlord. Therefore, the landlord expressly points out that it is up to the tenant to protect their device with antivirus software. A firewall or antivirus is suitable for this purpose. The landlord is not liable for any damages to digital media or devices of the tenant resulting from internet usage. Exceptions exist only in cases where damage was intentionally or grossly negligently caused by the landlord or their agents.
Claims from Third Parties
The tenant releases the landlord from all costs and expenses arising from possible claims by third parties if they are due to unlawful use of the internet connection or a violation of the agreed rules by the tenant. The tenant is also responsible for using the Wi-Fi and all resulting costs. This includes the use of paid services and legal transactions. The tenant agrees that they are solely responsible for all costs arising from using the Wi-Fi.
Tenant Responsibility
When using internet access, all German laws must be complied with by the tenant. The tenant agrees not to use internet access for the following or similar purposes:
-
Distribution, making available, or reproduction of copyrighted material (filesharing) or malware (viruses)
-
Downloading illegal content
-
Sending harassing, threatening, violent, defamatory, disreputable, immoral, or unlawful content
-
Sending bulk notifications or advertisements (spam)
-
Activities that violate applicable law, especially child and youth protection laws in any form
Data Protection
The username and connection data (IP address, MAC address, usage times) will be stored and processed as far as necessary for performance, error, or abuse analysis. The landlord reserves the right to disclose this user information at any time if deemed necessary to comply with applicable laws, regulations, legal proceedings, or requests from law enforcement authorities.
By accepting this agreement, the tenant declares that they have been informed of the existing rules and will comply with German laws.
